Dutch Gambling Authority Levies Unprecedented Penalties for Unlicensed Operations

The Kansspelautoriteit (KSA), the Netherlands' regulatory body for gambling, has recently announced a landmark enforcement action, imposing substantial fines on two entities found to be operating illicitly within the Dutch market. This includes the most significant penalty ever issued by the KSA to date, underscoring the regulator's firm stance against unlicensed activity.

On Tuesday, the KSA confirmed that Novatech and Fortaprime SRL were the subjects of these financial sanctions. Novatech received an unprecedented fine of €24,846,000, establishing a new record for penalties levied against illegal gambling activities in the country. Fortaprime SRL was also hit with a considerable fine totaling €1,795,000.

An extensive investigation conducted by the gambling watchdog revealed that both operators had been actively providing gambling services to residents in the Netherlands without the necessary licenses. Michel Groothuizen, Chairman of the KSA Board, articulated the regulator's approach to determining these penalties, stating: "We determine the fine based on the (estimated) turnover the illegal provider generated from players in the Netherlands."

Under current Dutch legislation, the KSA is empowered to issue turnover-related fines in instances where standard penalties would not adequately reflect the scale of the infringement. Both the Novatech and Fortaprime cases fell into this category, necessitating fines significantly higher than the typical statutory amounts. Groothuizen further explained that while the fine structure is linked to an operator's earnings from Dutch players, a legal ceiling dictates that any penalty cannot exceed 10% of the operator's total global turnover.

Highlighting the magnitude of Novatech's illicit activities, Groothuizen stated, "Novatech earned hundreds of millions from its illegal offering, primarily from Dutch players." He also underscored the impact of the 10% cap, noting, "A fine of 24 million sounds impressive, but without the 10% maximum, the fine would have exceeded 100 million euros; an amount that would be more appropriate for this offense."

The KSA's inquiry identified several platforms operated by these companies that were accessible to and utilized by Dutch customers. For Fortaprime, these included amonbet101.com, supraplay.com, amonbet.com, bilucky.com, gxspins.com, kaasino.com, hiddenjack.com, and luckymax7.com. Novatech's platforms found to be engaging Dutch residents in gambling activities were Qbet.com and 55Bet.com.

This decisive action by the KSA reinforces its commitment to maintaining a regulated and secure gambling market and combating unlicensed operations that circumvent Dutch law.
